Oregon OSHA adopted Division 1 civil penalty changes November 22, 2023. The changes were required by new 2023 law (Senate Bills 592 and 907). Revised civil penalty rules are effective January 1, 2024.
New law directed Oregon OSHA to increase civil penalties for some violations, and created a new violation, “Caused or Contributed to a Work-Related Fatality”.
As further guidance or experience develops concerning this penalty change, AOL will inform member employers.
These overreaching new increases include:
Serious violations increase to a range of $1,116 to $15,625 per violation
New serious violation, “Caused or Contributed to a Work-Related Fatality,” with penalties ranging from $20,000 to $50,000 per violation
Willful or repeat violations increase to range of $50,000 to $250,000 per violation
New violation, willful or repeat violation that caused or contributed to a work-related fatality, with penalties of $50,000 to $250,000 per violation.
